Minutes of the Meeting

Call to Order: President Pete Gulliver called the regular meeting of the Board of Directors of the Carolina Shores Property Owners Association to order at 2:00 P.M.

Board Members Present: Pete Gulliver, Bob Jones, Al Franklin, Brent Horten, John Manning, and Mike Riccitelli. Absent: Kerry Jarrell.

Approval of Minutes:
Pete presented the minutes for the regular Board Meeting of May 9, 2011, the April 20th Meeting and the May 2nd Community Meeting. John moved that the minutes be accepted. Al seconded the motion. The motion passed.

Resident Comment on Agenda Items:
Peter Kirkby, 19 Gate 6, stated that he felt that the volunteer Non-Disclosure Agreement was inappropriate for the ACC.

Carol and Helmet Kunst, 36 Bayberry Circle, objected to the Tuesday adult only swim.


Architectural Control:
Joe and Jeanne Zalasco requested a variance for a higher roof on their shed. The variance was not approved by the ACC. Peter Kirkby stated the shed looks like an addition to the house, but it is not tied into the house.

Ken Smith, 8 Landing Court, requested a hearing to appeal his citation for parking a commercial vehicle in his driveway. Mr. Smith stated that he normally keeps the vehicle covered. He questioned the date and time of the violation.

Bob reported that a letter was received complaining about Peter Kirkby's trespass on a neighbor's property. John Manning recommended that the matter be tabled until July. The Board agreed.

Nominating: Nothing to report.

Recreation: Pool Operations - Brent Horten reported that an unknown person removed the adult swim sign from the pool gate.

Pete reported that Marie Zaranski, 2 Northwest Drive, was concerned about bugs at the pool. The pool rope is being put on the fence during the morning lap swimming and insects are getting onto the rope. Karen Smiley was asked to check with the pest control service about the treatments that they are doing in the pool area and let Marie know what they say. Mrs. Zaranski also complained about the sand on the deck surface.

Pete reported that Linda Griffin, 6 Sand Dollar Court, requested a no-smoking area at the pool. Pete reported that the Recreation Committee suggested a sign-in sheet and comment form be made available at the pool and that the Board create a description of the pool attendants' duties. Pete and Brent will work on this.

Picnic report - Bob reported that approximately 225 residents attended the summer picnic. The total expense was about $700 less than last year. Some suggestions for next year were received and will be considered by the Recreation Committee next year. Jeanne and Joe Zalasko were thanked for doing a good job.

Clubhouse: Mike said the emergency egress ramp was started on June 13th. He has received quotes for possible replacement of the kitchen floor with bamboo or cork or ceramic materials. Pete suggested waiting for the building renovations to redo the kitchen floor.

Grounds: John reported that the irrigation improvements and plantings at Carolina Shores Parkway and Country Club Road have been completed. The irrigation improvements and plantings at the front of the clubhouse are not finished. There are three more irrigation heads to be put in. The irrigation improvements and plantings at the pool are scheduled to start the week of June 13th.

New lamp heads have been installed along the road to the pool parking lot. The new lamp heads provide much better lighting along that road. Handicapped parking spaces have been re-marked and concrete bumpers and signs have been installed.

Pete reported that the CSPOA received a civil citation for violation of the Town of Carolina Shores Ordinance 153.400, Tree Preservation. The CSPOA failed to obtain proper permits before removing trees. The citation imposed a fine and required replacement of the trees that were removed. The resolution of the citation will be covered in executive session.

Communications: Al advised that the directories would be available in about a week. The method of distribution has not been determined.

Mike questioned the guidelines for bulletin articles. The Board agreed that no discussion of outside events should be included in the CSPOA bulletin unless such items are public service announcements.

General Advisory Committee: Al reported that the following people were selected for the committee for 2011: Dan Mann, Terrie Ste. Marie, Jackie Orwig, Maslin Kain, Diana Mardall, and Peter Paff. John moved to accept these appointments. Mike seconded the motion. The motion passed. The first project for the committee will be a review of all past Board resolutions. The first meeting date has not been scheduled.

Legal Affairs: Nothing to report.

Town of Carolina Shores: Pete reported that the Town Board of Commissioners passed the budget for the next fiscal year.

Treasurer's Report: Since the treasurer was absent, the treasurer's report and purchasing guidelines were tabled until July.

Maintenance Committee: Nothing to report.

Old Business: Mike said he had not heard from Kerry about the signs for the pool. Pete suggested tabling the discussion until the July meeting.

New Business:
NON-DISCLOSURE AGREEMENTS - Pete reported that he had received signed agreements from the following: Pete Gulliver, Bob Jones, Kerry Jarrell, Brent Horten, John Manning, Mike Riccitelli, and Karen Smiley. Al Franklin stated that he objected to the wording of the document.

Residents Comments:
Joe Zalasko asked for clarification on when the new trees needed to be planted. Bob answered that they must be planted within six months at a cost of $100.00 a tree. Pete read the list of what needs to be done. The Board can appeal the citation to the Town Board of Adjustment if it objects to the citation.

The Board went into executive session at 3:55 P.M.
The Board reconvened at 5:10 P.M

Bob Jones moved that the variance request by Mr. And Mrs. Zalasco be approved. Mike seconded the motion. The motion carried.

Bob Jones moved to fine Ken Smith, the renter at 8 Landing Court, for the first violation regarding commercial vehicles. John seconded the motion. The motion carried.

Pete explained the details of the amended arrangement with the Town of Carolina Shores on the citation for removing trees without a permit. He quoted from a letter from Town Code Enforcement Officer, Charles Riggens:

"The policy of the Town of Carolina Shores, through the 'Tree Preservation Regulations'
is to maximize the planting of trees. With that vision in mind, I make the following offer in lieu of the all-cash fine as stated above. The alternate fine is for four(4) trees to be replaced for each of the six trees removed without a permit for a total of twenty-four (24) trees, plus a $600 cash fine. The variety of tree should come from the list provided by our Tree Committee, must be planted within six (6) months, and must be living twelve months after planting."

Mike moved to accept the amended arrangement with the Town of Carolina Shores rather than appeal the citation. Brent Horten seconded the motion. The motion carried.

The next meeting is scheduled for July 11, 2011 at 2:00 P.M.
